This document (together with the documents mentioned in the annex) establishes the conditions that determine the use of this website www.caminhoportuguesdesantiago.eu and the purchase of products on it (hereinafter the "Conditions").
Please read these conditions, our cookie policy and our privacy policy carefully before using this website. By using this website or placing an order through it, you are aware that you must comply with these conditions and our privacy policies. Therefore, if you do not agree with all the conditions and the privacy policies, you should not use this website.

The purpose of these terms and conditions is to define the general terms and conditions of sale established between VPAMS LDA and the User (natural persons), from the moment an order is placed to the various services provided by VPAMS LDA, such as payment methods and delivery conditions.
These conditions regulate all the steps required to place the order and guarantee the follow-up of this transaction between the contracting parties.

In compliance with Law 67/98 of October 26 on the Protection of Personal Data, we hereby inform you that the processing of personal data collected on the www.caminhoportuguesdesantiago.eu website is the responsibility of VPAMS Lda. The personal data is processed by computer and is used for sending your orders, administrative support and statistical purposes.

3.1 NEWSLETTER SUBSCRIPTION
VPAMS LDA offers visitors to its website www.caminhoportuguesdesantiago.eu the possibility of subscribing to a free newsletter. The aim of this service is to provide subscribers with relevant information on the areas of interest covered by the Portuguese Camino de Santiago. In order to take advantage of this service, you must provide your e-mail address in the field provided. You can unsubscribe from the Newsletter service at any time by sending an e-mail or following the instructions at the end of each Newsletter. You can also do this directly by clicking on the manage subscription button in the body of the newsletter itself.
VPAMS LDA guarantees all Users free access to their personal data, with the aim of updating, modifying, rectifying and canceling any type of information previously provided. To this end, the User should contact VPAMS LDA using the e-mail address info@caminhoportuguesdesantiago.eu.
Data processing is subject to the provisions of the Data Protection Act and has been notified by VPAMS LDA to the National Data Protection Commission (CNPD) under case number 9265/2018.
By using our website you are implicitly agreeing to the use of your personal data in the terms described above.
As our website grows and new technologies are adopted, it may be necessary to make changes to our Usage and Privacy Policy. VPAMS Lda reserves the right to modify its Use and Privacy Policy at any time.

4. CONCLUSION OF THE CONTRACT
To place an order, you must follow the online purchase procedure and click on "Checkout", before which you must read and accept these Conditions of Purchase. By doing so, you are entering into a sales contract with us (the "Contract"). You will then receive an e-mail acknowledging receipt of your order (the "Order Confirmation"). You will also receive an e-mail in which we confirm that the order has been shipped (the "Delivery Confirmation").
5. THE ORDER
Users can place their orders online at www.caminhoportuguesdesantiago.eu.
To finalize your order, you must provide personal details, such as your user number (which is strictly personal) or your name, address, etc. To do this, the user must fill in all the mandatory fields on the order form for this purpose. If you are a new user, the site will assign you a user number as soon as you place your first order.
By placing your order, you signify your full and complete acceptance of the general conditions of sale, the prices and the description of the products included in this transaction. These general conditions of sale will be the only ones applicable between the two parties.
Any dispute on this last point will be resolved through an exchange of information and with the guarantees mentioned below.
If the product is unavailable, VPAMS Lda undertakes to inform the User and reimburse them for any amounts paid within a maximum period of 30 (thirty) days from the date of knowledge of the unavailability.
6. THE DELIVERY
We guarantee that all our products will be sent with the utmost care and efficiency. We use the reliable services of CTT Express to guarantee safe delivery of items. Delivery times are:
Mainland Portugal: 5 working days
Portugal Islands: Up to 14 working days
Spain: 5 working days
Europe: Up to 7 working days
Rest of the World: Up to 14 working days
7. PRICE AND PAYMENT
The prices on this website include VAT but do not include shipping costs, which will be added to the total amount due. Any changes to the type of VAT applicable will be reflected in the product prices.
You can pay by Visa, Mastercard, American Express, Mbway, MultiBanco or bank transfer.
To reduce the risk of unauthorized access, your credit card details will be encrypted. Upon receipt of your order, we will pre-authorize your card to ensure that there are sufficient funds to complete the transaction. By clicking on "Checkout", you confirm that the credit card is yours or that you are the legitimate owner of the gift card or payment card.
Credit cards are subject to verification and authorization by the issuing entities, but if they do not authorize payment, we will not be responsible for any delay or lack of delivery and we will not be able to formalize any Contract with the client.
Your card will be charged as soon as your order leaves our warehouses.
If your payment method is Mbway or Multibanco, the debit will be made when we confirm your order.
8. RETURN
According to the applicable rules, if you are contracting as a consumer, you have the legally established right to withdraw from the contract within 14 days of its conclusion without giving any reason.
To exercise the right to withdraw from the contract, the customer can contact us by email at info@caminhoporuguesdesantiago.eu. However, the consumer can exercise the right of withdrawal by any means, and it is not compulsory to use any of the above means.
In order to respect the period of free withdrawal from the contract, simply send your communication regarding your exercise of the right of withdrawal before the period of withdrawal from the contract expires.
If the customer terminates the Contract, we will refund the amount paid for the products, without undue delay and provided that it does not exceed 14 days from the day we receive the products back, or until the customer shows evidence that they have returned them. We will make the refund using the same payment method as the customer used for the original transaction. In any case, the customer will not pay any fees for this refund. Notwithstanding the above, we may withhold the refund until we receive the products back, or until the customer shows evidence that they have been returned.
The customer must bear the return costs.
8.1 DEFECTIVE PRODUCTS
In cases where the customer considers that, at the time of delivery, the product does not comply with the provisions of the contract, the customer must contact us within the legally set period of two months by emailing info@caminhoporuguesdesantiago.eu.
9. INTELLECTUAL PROPERTY
The customer acknowledges and consents that all copyright, trademark and other intellectual property rights in the materials or content that are provided as part of the website are, at all times, ours or those of the person who has granted us the license to use them. You may only use this material in the manner expressly authorized by us or by the person who granted us the license to use it. This does not prevent you from using this website to copy the information relating to your order or the details of the Contract as necessary.
WRITTEN COMMUNICATION
Applicable legislation requires that part of the information or notifications we send must be in writing. By using this website, you agree that most notifications to us will be electronic. We will contact you by email or provide information through notices placed on this website. For contractual purposes, you agree to use this electronic means of communication and acknowledge that all contracts, notices, information and other notices sent electronically satisfy the legal requirement that such notices be in writing. This condition shall not affect the rights recognized by law.
10. FORCE MAJEURE
We shall not be liable for any breach or delay of any of our obligations under a Contract caused by events beyond our control (Force Majeure).
The concept of Force Majeure shall include any act, event, failure to act, omission or accident beyond our control, including but not limited to the following:
i. General strike, or other forms of protest that significantly affect the country.
ii. Disturbance of public order, riot, invasion, terrorist attack or terrorist threat, war
(declared or not) or threat or preparation for war.
iii. Fire, explosion, storm, flood, earthquake, landslide, epidemic or any other
natural disaster.
iv.Inability to use trains, boats, aircraft, motor transportation or other means of
public or private transport.
v. Inability to use public or private telecommunications systems.
Our obligations under the Contracts shall be deemed to be suspended during the period in which the Force Majeure occurs and we shall benefit from an extension of the period for fulfilling such obligations, for a period of time equal to the duration of the Force Majeure. We will use all reasonable means to bring the Force Majeure to an end or to find a solution that allows us to fulfill our obligations under the Contract, despite the Force Majeure.
11. WAIVER RIGHTS
Our failure to require strict compliance by you with any of your obligations under a Contract or these Conditions, or our failure to exercise any rights or actions due under such Contract or Conditions, shall not be construed as a waiver or limitation of such rights or actions, nor shall it relieve you of your obligations.
No waiver by us of a specific right or action shall imply a waiver of our rights or actions under the Contract or the Conditions.
No waiver by us of any of these Conditions or of the rights or actions derived from the Contract shall be effective unless it is expressly established that it is a waiver, formalized and communicated to the customer in writing in accordance with the provisions of clause 21 above.
12. PARTIAL ANNULMENT
If any of these Conditions or any provision of a Contract is declared null and void by firm resolution of a competent authority, the remaining terms and conditions shall continue in force without being affected by such declaration of nullity.
13. SINGLE AGREEMENT
These Conditions and all documents to which express reference is made constitute the entire agreement between us and you in relation to the subject matter of the Contract and supersede any other covenant, agreement or promise previously entered into between us and you, whether orally or in writing.
We and the customer acknowledge that we have consented to the conclusion of the Contract without having relied on any statement or promise made by the other party or that may interfere with any written statement in the negotiations entered into by both parties prior to this Contract, except for what is expressly mentioned in these Conditions.

15. DISPUTE RESOLUTION AND ALTERNATIVES
In this regard, if the transaction has been concluded through our website, we inform you - in accordance with EU Regulation 524/2013 - that you have the right to try to resolve any dispute out of court by accessing the electronic online dispute resolution platform at http://ec.europa.eu/consumers/odr/.
